1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern access to and use of the gigs&works mobile application, website and related services (collectively, the “Platform”). By creating an account, posting a task, accepting an offer, making or receiving a payment, running an advertisement, or otherwise using the Platform, you agree to these Terms and any applicable policies referenced in them.

If you do not agree, you must not use the Platform. We may update these Terms from time to time. Where changes materially affect users, the Platform should provide reasonable notice before the changes take effect, subject to applicable Ghanaian law.

2. Eligibility and User Registration

  • Users must register using either a valid student ID or a valid Ghana Card, subject to verification requirements.
  • Users must provide accurate, current and complete information and must not impersonate another person or create an account using another person's identity.
  • The Platform may require additional information or verification where reasonably necessary to prevent fraud, protect users, comply with law, or investigate disputes.
  • Users are responsible for keeping their login credentials secure and for activity conducted through their account, unless the user promptly reports unauthorized access.
  • The Platform may refuse registration, restrict an account, or suspend/terminate access where verification fails or where there is a reasonable basis to suspect fraud, abuse, unlawful conduct or a breach of these Terms.

3. Age and Legal Capacity

Users must be legally capable of entering into the relevant transaction. If the Platform permits persons under 18 to use any feature, the operator should implement appropriate parental/guardian consent and safeguarding procedures before allowing such use. Users must not use the Platform for work or transactions prohibited for their age under Ghanaian law.

4. Roles: Taskers and Clients

Tasker: a user who offers to perform a task or provide a service.

Client: a user who posts a task, accepts an offer, commissions a service, or otherwise engages a Tasker.

A user may act as both a Tasker and a Client. Each role carries the obligations applicable to that transaction.

5. Tasks, Offers and Agreements

  • Clients must describe tasks honestly, including material requirements, deadlines, location where relevant, deliverables and any safety considerations.
  • Taskers must only accept work they are qualified, authorized and reasonably able to perform.
  • Once a Client accepts an offer and the required payment is made to the Platform, the transaction is treated as a confirmed engagement, subject to the dispute, cancellation and refund provisions in these Terms.
  • Users must not post or accept tasks involving unlawful goods or services, fraud, harassment, exploitation, dangerous activities without lawful safeguards, or conduct that violates Ghanaian law.
  • The Platform may review, monitor, remove or suspend tasks, offers, accounts or other content where it detects suspicious, unsafe, fraudulent or prohibited activity.

6. Platform Fees and Payouts

  • The Platform currently charges a service fee equal to 12% of the Tasker's payout amount, unless a different fee is clearly displayed and accepted before the relevant transaction.
  • Taskers receive the applicable net payout after the Platform's fee and any other clearly disclosed, legally permitted deductions.
  • Subject to successful completion, verification and any applicable dispute or compliance hold, Tasker payouts are intended to be released two (2) working days after the relevant payout becomes due.
  • Payment processing, banking, mobile-money or other third-party charges may apply where disclosed. The Platform should identify such charges before payment where reasonably practicable.
  • Users must not use the Platform to circumvent fees or move an active Platform transaction off-platform for the purpose of avoiding Platform charges.

7. Payments, Cancellations and Refunds

  • Payments made through the Platform may be held or processed in accordance with the transaction flow displayed to the user.
  • Once a Tasker has agreed to an offer and the Client has paid money to the Platform, refunds are generally not available merely because a user changes their mind.
  • A refund or reversal may be considered where there is a tangible and verifiable reason, such as material non-performance, duplicate payment, unauthorized payment, fraud, a Platform error, or another circumstance requiring relief under applicable law.
  • Nothing in this section removes any mandatory consumer, payment, contractual or other legal right that cannot lawfully be excluded.
  • Where a refund is approved, the method and timing of the refund may depend on the original payment method and the applicable payment provider.

8. Disputes and Complaints

  • Users should use the Platform's Dispute section to report problems relating to a task, payment, delivery, communication, account, suspected fraud or other Platform issue.
  • Users should provide relevant evidence, such as messages, receipts, photographs, deliverables, timelines or other information needed to assess the complaint.
  • The Platform may request information from the parties, temporarily hold funds where the payment arrangement permits it, review relevant Platform records, and make a decision based on the available evidence and applicable law.
  • Users must cooperate honestly with dispute investigations and must not submit knowingly false or misleading reports.
  • Where a matter cannot be resolved internally, the parties retain any rights available under applicable Ghanaian law, including applicable consumer protection, contractual and court or alternative-dispute mechanisms.

9. Advertising on the Platform

  • Businesses or users running advertisements must provide lawful, accurate and non-misleading advertising content.
  • Advertisers are responsible for ensuring that their products, services, claims, pricing and promotional materials comply with applicable Ghanaian advertising and consumer-protection requirements.
  • Once an advertising placement has been paid for, advertising fees are generally non-refundable. A refund may be considered only where there is a tangible and verifiable reason, such as a material Platform failure, duplicate payment, unauthorized payment, or another circumstance requiring relief under applicable law.
  • The Platform may reject, pause or remove advertisements that are unlawful, deceptive, unsafe, offensive, misleading, infringing, or inconsistent with Platform policies.

10. Prohibited Conduct and Scam Prevention

  • Scam activity, attempted fraud, identity misuse, phishing, fake payments, chargeback abuse, theft, harassment, threats, money laundering, financing of unlawful activity and other illegal conduct are prohibited.
  • Users must not ask another user to pay outside the agreed Platform process where doing so is intended to defeat Platform protections or fees.
  • Users must not manipulate ratings, reviews, offers, task completion records or dispute outcomes.
  • Reported scam activity may result in investigation and suspension. Accounts may be suspended or terminated where the Platform reasonably believes a user has engaged in scam activity or materially breached these Terms.
  • The Platform may preserve relevant records and cooperate with competent authorities where legally required or reasonably necessary to aid a lawful investigation.

11. Task Monitoring and Safety

Tasks and activity on the Platform may be monitored using automated systems and/or human review for safety, fraud prevention, compliance and quality control. Suspicious tasks may be suspended or removed pending review. Monitoring does not guarantee that every unlawful or unsafe activity will be detected.

Users should never share passwords, PINs, one-time passwords, full payment credentials or other sensitive authentication information with another user. Users should report suspected scams promptly through the Dispute/reporting tools.

12. Privacy and Personal Data

The Platform will handle personal data in accordance with its privacy notice and applicable Ghanaian data-protection requirements. User data is confidential and will only be disclosed to third parties or competent authorities where permitted or required by law, or where reasonably necessary for legitimate investigations, fraud prevention, safety, legal claims, or operation of the Platform.

The operator should maintain appropriate technical and organizational safeguards, limit access to personal data to authorized persons, retain information only as long as reasonably necessary or legally required, and provide users with the rights and notices required under applicable data-protection law.

Where applicable, the Platform should register/comply with requirements of the Data Protection Commission of Ghana and maintain a separate privacy policy explaining data collection, purposes, lawful basis, retention, user rights, and complaint procedures.

13. Intellectual Property and User Content

  • The Platform, its software, branding, design, logos and original content are owned by or licensed to the Platform operator and may not be copied or exploited without permission.
  • Users retain ownership of content they lawfully own, but grant the Platform a limited, non-exclusive licence to host, display, process and use that content as reasonably necessary to operate, secure and promote the Platform.
  • Users must not upload content that infringes another person's intellectual-property, privacy, publicity or other legal rights.

14. Ratings, Reviews and Communications

Reviews and ratings must reflect genuine experiences and must not contain threats, discrimination, personal attacks, false allegations, confidential information, spam or attempts to manipulate another user's reputation. The Platform may remove content that violates these Terms or applicable law.

15. Third-Party Services

Payments, identity verification, communications, hosting and other functions may involve third-party service providers. Their own terms and privacy notices may apply. The Platform is not responsible for a third party's independent acts or outages except to the extent liability cannot lawfully be excluded.

16. Platform Availability and Liability

The Platform is provided on an ongoing basis but may occasionally be unavailable because of maintenance, technical faults, security events, network failures or circumstances outside the operator's reasonable control.

To the extent permitted by Ghanaian law, the Platform does not guarantee the quality, legality, safety, identity, qualifications or performance of any user, Tasker, Client, advertiser, task or third-party service. Users transact with other users at their own risk.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability arising from fraud or other mandatory legal protections.

17. Indemnity

To the extent permitted by law, a user may be responsible for losses, claims, costs or liabilities arising from that user's unlawful conduct, fraud, breach of these Terms, infringement of third-party rights, or misuse of the Platform.

18. Suspension and Termination

  • The Platform may suspend, restrict or terminate an account where necessary for safety, fraud prevention, investigation, non-payment, repeated complaints, violation of these Terms, or compliance with law.
  • Where appropriate and legally permissible, the Platform may provide notice and an opportunity to respond or appeal.
  • Termination does not automatically cancel obligations or liabilities that arose before termination.

19. Ghanaian Law and Dispute Resolution

These Terms are intended to be governed by the laws of the Republic of Ghana, subject to any mandatory legal protections applicable to a user. The operator should specify its registered business address and the competent forum or alternative-dispute process applicable to disputes before publishing these Terms.

Nothing in these Terms prevents a consumer or other protected party from exercising a right that cannot legally be waived.

20. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to the extent permitted by law. These Terms, together with the Platform's Privacy Policy and other policies expressly incorporated into them, form the agreement governing use of the Platform, subject to any mandatory legal rights.

By registering or using gigs&works, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
